Terms of Service

1.Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you and FitHuddle ("FitHuddle", "we", "our", or "us"), an independent app project based in India, governing your use of the FitHuddle mobile application, the fithuddle.app website, and the related backend services (together, the "App").

By downloading, installing, creating an account on, or otherwise using the App, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the App.

2.Eligibility

You must be at least 13 years old to use FitHuddle. By using the App you represent and warrant that you meet this requirement. If you are under 18, or under the age of majority where you live, you should review these Terms together with a parent or legal guardian, and you may use the App only with their consent.

You are responsible for ensuring that your use of the App complies with the laws that apply to you. You may not use the App if you are barred from doing so under any applicable law, or if we have previously terminated your account.

3.Your Account

Most features require an account, which you can create with an email address and password or by signing in with your Google account. You agree to:

• Provide accurate, current, and complete information when registering, and keep it up to date.
• Keep your password and any authentication credentials confidential, and not share your account with anyone else.
• Take responsibility for all activity that occurs under your account.
• Notify us immediately at support@fithuddle.app if you suspect unauthorised access to your account.

You may maintain only one account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.

You may delete your account at any time from Profile → Delete Account in the App. Deletion is permanent and irreversible — see Section 19 and Section 12 of the Privacy Policy.

4.Acceptable Use

You agree to use FitHuddle only for lawful purposes and in a way that respects other users. You must not:

• Post, share, or transmit content that is abusive, harassing, threatening, hateful, defamatory, obscene, or otherwise objectionable.
• Impersonate any person or entity, or misrepresent your identity or affiliation.
• Upload a profile photo or display name that infringes someone else's rights or is offensive.
• Transmit spam, malware, viruses, or any other harmful code.
• Attempt to reverse-engineer, decompile, disassemble, modify, or create derivative works of the App, except to the extent that applicable law expressly prohibits this restriction.
• Probe, scan, or test the vulnerability of our systems, circumvent authentication, or access data belonging to another user.
• Use bots, scrapers, emulators, or other automated means to interact with the App or our backend, or to place artificial load on our services.
• Falsify, manipulate, or artificially generate activity data, GPS routes, step counts, leaderboard standings, or challenge results — see Section 7.
• Use the App in a way that interferes with, disrupts, or degrades the service for anyone else.
• Resell, sublicense, or commercially exploit the App or any data obtained from it without our written consent.

We may investigate suspected violations and may suspend or terminate accounts involved, with or without notice.

5.Fitness & Health Disclaimer

Before beginning any new exercise programme, changing your activity level, or acting on anything you see in the App, consult a qualified healthcare professional — particularly if you are pregnant, have a pre-existing medical condition, or are recovering from injury or illness.

You participate in physical activity entirely at your own risk. You are solely responsible for exercising safely, for being aware of your surroundings, and for obeying traffic and other laws while tracking an outdoor activity. Do not interact with your phone while doing anything that requires your attention. To the fullest extent permitted by law, FitHuddle is not liable for any injury, illness, death, property damage, or other harm arising from physical activity undertaken while using the App.

If you experience pain, dizziness, shortness of breath, or any other symptom of distress during exercise, stop immediately and seek medical attention.

6.Accuracy of Tracking Data

Activity metrics produced by the App — distance, pace, speed, elevation, step counts, and calorie estimates — are estimates. Their accuracy depends on factors outside our control, including GPS signal quality, weather, terrain, your device's sensors and their calibration, battery-optimisation settings imposed by your device manufacturer, and the accuracy of the profile details you enter.

Calorie figures in particular are approximations derived from generalised formulas and should not be used for medical or clinical purposes, or as the basis for a diet or weight-management programme.

Data imported from Health Connect originates in other applications and devices. We present it as recorded and are not responsible for its accuracy, completeness, or availability.

7.Challenges, Leaderboards & Fair Play

FitHuddle lets you create and join challenges, and ranks participants on a leaderboard. By taking part, you agree that:

• Other participants in a challenge can see your display name, profile photo, and progress on the tracked metric, along with your leaderboard position. If you would rather not share this, do not join the challenge.
• You will submit only activity you genuinely performed. Using vehicles, treadmill spoofing, GPS-spoofing apps, shaking your device to generate steps, editing data before it syncs, or any comparable technique is prohibited.
• We may recalculate, adjust, void, or remove results and standings that we reasonably believe to be inaccurate or fraudulent, and may disqualify or suspend accounts involved.
• Challenges are for motivation only. Unless we state otherwise in writing for a specific challenge, they carry no prize, monetary value, or other consideration, and are not a contest, lottery, sweepstakes, or game of chance.
• Anyone with a challenge invite link or QR code can view and join that challenge. You are responsible for who you share those links with.

If you create a challenge, you are responsible for its title, description, and rules, and for ensuring they comply with Section 4.

8.Your Content

You retain ownership of everything you submit to the App — your profile details and photo, your activity and route data, and any challenge titles or descriptions you write ("Your Content").

You grant FitHuddle a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, transmit, adapt, and display Your Content, solely for the purpose of operating, maintaining, securing, and improving the App and providing it to you and — where you have chosen to share, such as in a challenge — to the other users entitled to see it. This licence exists so we can technically run the service; it does not give us the right to use Your Content for advertising or to publish it outside the App. It ends when you delete the content or your account, subject to reasonable backup retention periods and to Section 12 of the Privacy Policy.

You represent that you have the rights necessary to submit Your Content and that it does not infringe anyone else's rights or violate any law. You are solely responsible for Your Content. We may remove content that violates these Terms, but we have no obligation to monitor or screen content, and we do not endorse any user content.

9.AI-Generated Insights

The App can generate short daily and weekly coaching summaries using a third-party AI model. You acknowledge that:

• AI-generated text may be inaccurate, incomplete, generic, or unsuitable for your circumstances. It is provided for general motivation only.
• It is not medical, nutritional, or professional advice, and Section 5 applies to it in full.
• You should exercise your own judgment, and consult a professional, before acting on any suggestion the App makes.
• Generating these insights involves sending aggregate fitness metrics to a third-party provider. Please read Section 7 of our Privacy Policy before using the feature, as it explains exactly what is sent and how that provider may use it.

10.Beta Software

FitHuddle is currently offered as beta software. It may contain bugs, incomplete features, and errors; features may change or be removed without notice; and data loss, while we work hard to avoid it, is possible. Beta functionality is provided on an "as is" basis and is excluded from any commitment as to performance or availability. You are encouraged to report issues to support@fithuddle.app.

11.Paid Plans & Subscriptions

The App is presently free to use. If we introduce paid plans or subscriptions in future, the following will apply, and we will give you notice and the specific pricing and renewal terms before you are charged anything:

• Purchases will be processed by Google Play and will be governed by Google Play's terms in addition to these Terms. We do not receive or store your payment card details.
• Subscriptions renew automatically for the stated period unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Google Play account settings.
• Refunds are handled under Google Play's refund policy and any non-waivable rights you have under applicable consumer law.
• Prices may change; we will give you reasonable advance notice, and any change will apply only from your next renewal.
• If a paid plan lapses, you keep access to your data but paid features become unavailable.

12.Intellectual Property

The App and everything in it other than Your Content — including the FitHuddle name, logo, branding, user interface, design, text, graphics, and underlying software — is owned by FitHuddle or its licensors and is protected by copyright, trade mark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use one copy of the App on devices you own or control, for your own personal, non-commercial use. All rights not expressly granted are reserved. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the App, or remove any proprietary notices from it.

13.Third-Party Services

The App relies on third-party services, including Supabase, Google (Firebase, Sign-In, Health Connect, Play services, and the Gemini API), and Mapbox. Your use of the App may also be subject to those providers' own terms and privacy policies. We do not control these services, are not responsible for their content, availability, accuracy, or practices, and do not endorse them. A failure or change in a third-party service may affect or interrupt the App.

Health Connect access is granted and revoked by you through your device settings and is governed by Google's terms in addition to these Terms.

14.Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the App you acknowledge that you have read it. Because FitHuddle handles health, fitness, and precise location data, we encourage you to read it in full rather than relying on this summary reference.

15.Availability & Changes to the App

We aim to keep the App available and working, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any feature, or the App as a whole, at any time. Where a change is material and we can reasonably do so, we will give advance notice and, if we discontinue the App entirely, a reasonable opportunity to export or delete your data. Scheduled maintenance, third-party outages, and force majeure events may cause interruptions.

16.Disclaimer of Warranties

To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory — including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or quiet enjoyment.

We do not warrant that the App will meet your requirements, be uninterrupted, timely, secure, or error-free, that defects will be corrected, that data will not be lost, or that any metric, estimate, or insight it produces will be accurate.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you, and nothing in these Terms limits any non-waivable rights you have as a consumer under the law of your country of residence.

17.Limitation of Liability

To the maximum extent permitted by law, FitHuddle and its operators, contributors, and suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, or data, arising out of or in connection with your use of or inability to use the App — even if we have been advised of the possibility of such damages, and regardless of the legal theory on which the claim is based.

To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to these Terms or the App shall not exceed the greater of (a) the total amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) INR 1,000.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

18.Indemnity

You agree to indemnify and hold harmless FitHuddle and its operators from any claim, demand, loss, liability, or expense (including reasonable legal fees) brought by a third party and arising out of your breach of these Terms, your misuse of the App, Your Content, or your violation of any law or the rights of another person. This does not apply to the extent the claim arises from our own breach or negligence.

19.Termination

By you. You may stop using the App at any time, and may permanently delete your account and all associated data from Profile → Delete Account in the App. Deletion is immediate and irreversible.

By us. We may suspend or terminate your access, with or without notice, if you breach these Terms, if we reasonably believe your conduct harms other users or the App, if we are required to do so by law, or if we discontinue the App. Where circumstances allow, we will give notice and an opportunity to remedy the issue.

On termination, your licence to use the App ends immediately. Sections 5, 8, 12, 16, 17, 18, 20, and 22 survive termination.

20.Governing Law & Disputes

These Terms and any dispute arising out of or relating to them or to the App are governed by the laws of India, without regard to conflict-of-laws principles. Subject to the paragraph below, the competent courts in India shall have exclusive jurisdiction.

If you are a consumer resident in a country whose law grants you the right to bring proceedings in your local courts or to the benefit of mandatory protections you cannot contract out of, nothing in this section deprives you of those rights.

Please contact us first. Before starting any formal proceedings, we ask that you email support@fithuddle.app so we can try to resolve the matter informally. Most issues can be sorted out quickly this way.

21.Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If the changes are material, we will give reasonable advance notice in the App or by email before they take effect.

Your continued use of the App after a change takes effect constitutes acceptance of the revised Terms. If you do not agree to a change, stop using the App and delete your account.

22.General

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and FitHuddle regarding the App and supersede any prior agreement on the subject.
• Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary, or severed, and the remaining provisions remain in full force.
• No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment. You may not assign or transfer these Terms without our written consent. We may assign them to a successor in connection with a merger, acquisition, or sale of assets.
• No third-party beneficiaries. These Terms create no rights for anyone other than you and us.
• Force majeure. Neither party is liable for failure to perform due to causes beyond its reasonable control.
• Language. These Terms are drafted in English. Any translation is provided for convenience, and the English version prevails in the event of conflict.
